Link Foundation AOD operates the Traffic Offenders Intervention Programme (TOIP) and is committed to protecting your privacy. This Privacy Policy explains how we collect, use, disclose, and safeguard your personal information in accordance with the Australian Privacy Principles under the Privacy Act 1988 (Cth).

2. Information We Collect

We collect the following types of personal information when you enroll in or participate in TOIP:

  • Full name and date of birth
  • Email address and contact telephone number
  • Gender and Aboriginal or Torres Strait Islander status (optional)
  • Preferred contact method
  • Country of birth and primary language spoken at home (optional)

2.2 Identification Information

  • Driver licence number or other identification documents
  • Identification type used for verification

2.3 Offence and Court-Related Information

  • Nature of traffic offence(s)
  • Date of offence(s)
  • Court name and location
  • Court date and date of next court appearance
  • Date of referral

2.4 Programme Participation Information

  • Course attendance records
  • Course completion status and module completion
  • Course delivery method (online or face-to-face)
  • Preferred location and course date/time
  • Work and Development Order (WDO) information (if applicable)
  • Payment information (processed securely through Stripe)

2.5 Criminal Offence Information

We collect information about your traffic offences as part of your referral to TOIP. This information relates to criminal offences and is collected in accordance with s.6.4 of the Australian Privacy Principles.

3. How We Collect Information

We collect personal information directly from you through:

  • Online enrolment forms on our website (Enrol Form Link)
  • Email correspondence
  • Telephone conversations
  • In-person registration at our venues
  • Student workbooks and programme materials

We may also collect information from third parties including:

  • Courts and legal representatives when you are referred to TOIP
  • Service NSW or other government agencies regarding court matters
  • Your nominated solicitor (with your consent)

4. Why We Collect and Use Your Information

We collect and use your personal information for the following purposes:

4.1 Primary Purposes

  • To assess your eligibility for TOIP enrolment
  • To deliver the TOIP programme to you
  • To monitor and record your attendance and participation
  • To issue certificates of completion
  • To prepare court reports on your programme completion or non-completion
  • To process your course fees through our payment provider

4.2 Secondary Purposes

  • To communicate with you about your course schedule and programme updates
  • To respond to your enquiries
  • To comply with legal obligations, including court orders and reporting requirements
  • To improve our programme delivery and services
  • To maintain accurate records for quality assurance and regulatory compliance

We will only use your personal information for purposes directly related to TOIP unless you consent otherwise or we are permitted or required by law.

5. Disclosure of Your Information

We may disclose your personal information to:

5.1 Courts and Legal Entities

  • The court that referred you to TOIP or where you are appearing
  • Your legal representative (with your consent)
  • Service NSW for fine management purposes

5.2 Service Providers

  • Stripe: Our payment processor for secure handling of course fees. Stripe's privacy policy is available at https://stripe.com/au/privacy
  • IT service providers who assist with our website and data management systems
  • Administrative support providers who help deliver the programme

5.3 Other Disclosures

  • Work and Development Order (WDO) programme administrators (if applicable to your enrolment)
  • Law enforcement or regulatory authorities where required by law

We do not sell, rent, or trade your personal information to third parties for marketing

All third-party service providers are required to protect your personal information and use it only for the purposes we specify.

6. Data Storage and Security

We take reasonable steps to protect your personal information from misuse, interference, loss, unauthorised access, modification, or disclosure.

6.1 Security Measures

  • Information is stored on secure servers with password protection
  • Electronic records are encrypted where appropriate
  • Physical records are stored in locked filing cabinets in secure facilities
  • Access to personal information is restricted to authorised staff only
  • Staff are trained in privacy obligations and confidentiality

6.2 Retention

We retain your personal information for:

  • Programme records: Seven (7) years after course completion, in accordance with legal and regulatory requirements
  • Court-related records: As long as necessary to fulfil court reporting obligations

After the retention period, records are securely destroyed or de-identified.

De-identified information may be used for reporting, quality improvement, or funding compliance.

6.3 Overseas Disclosure

Your payment information is processed by Stripe, which may store or process data on servers located overseas. Stripe complies with international data protection standards. We do not otherwise disclose personal information overseas.

7. Your Rights and Choices

Under the Privacy Act 1988, you have the following rights:

7.1 Access to Your Information

You may request access to the personal information we hold about you. To make a request, please contact us in writing using the details in Section 11.

We will respond to your request within 30 days. There is no fee for requesting access, though we may charge a reasonable fee for retrieving and copying extensive records.

7.2 Correction of Your Information

If you believe your personal information is inaccurate, out-of-date, incomplete, or misleading, you may request correction. We will take reasonable steps to correct the information within 30 days.

If we refuse your correction request, we will provide written reasons and you may request a statement be attached to your record noting your disagreement.

7.3 Withdrawal of Consent

Where we rely on your consent to collect or use your information, you may withdraw consent at any time. However, this may affect our ability to provide TOIP services to you or fulfil court reporting requirements.

7.4 Anonymity and Pseudonymity

Due to the nature of TOIP (court-referred or court-related programme), we cannot provide services anonymously or under a pseudonym as we require verified identification for court reporting purposes.

8. Complaints

If you believe we have breached the Australian Privacy Principles or have a complaint about how we have handled your personal information, please contact us using the details in Section 11.

Your complaint will be:

9. Changes to This Privacy Policy

We may update this Privacy Policy from time to time to reflect changes in our practices or legal requirements. The updated policy will be posted on our website with a revised "Last Updated" date.
