1. Acceptance of Terms

By accessing this website, enrolling in the Traffic Offenders Intervention Programme (TOIP), or using any services provided by Link Foundation AOD (ABN: 59665374185), you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions.

If you do not agree with these terms, you must not use this website or enrol in our programmes.

2. Purpose of This Website

This website provides information about the Traffic Offenders Intervention Programme (TOIP) and facilitates online enrolment for:

  • Face-to-face TOIP courses delivered at Penrith
  • Online TOIP courses delivered via Zoom

The website allows prospective participants to:

  • Learn about the TOIP programme structure and requirements
  • View course schedules and pricing
  • Complete registration and payment
  • Access course materials and information

4. Nature of Service and Disclaimers

We collect and use your personal information for the following purposes:

4.1 Educational Programme

TOIP is a voluntary educational intervention programme regulated under the Criminal Procedure Act 1986. The programme delivers road safety education content designed to promote driver self-reflection and positive attitudes to driving.

4.2 No Legal Advice

Link Foundation AOD does not provide legal advice. While we provide court reports upon successful completion of the programme, participants should consult their own legal representatives regarding:

  • How completion of TOIP may affect their court proceedings
  • Legal implications of their traffic offences
  • Sentencing outcomes

4.3 No Guarantee of Outcomes

Completion of TOIP does not guarantee:

  • Reduction or dismissal of charges
  • Specific sentencing outcomes
  • Retention of driver's licence
  • Any particular court decision

While magistrates often view TOIP completion favourably, sentencing decisions remain at the discretion of the presiding magistrate.

4.4 Programme Recognition

TOIP is a Department of Justice and Transport for NSW approved programme. Link Foundation AOD is an approved TOIP provider. Completion certificates are recognised by NSW courts and Service NSW.

5. Traffic Offender Intervention Programme Rules

By enrolling in TOIP, participants agree to comply with all programme requirements as outlined in the TOIP Operating Guidelines and by Link Foundation AOD.

5.1 Mandatory Attendance

Participants must attend all scheduled sessions. The programme requires:

  • Face-to-face option: One full Saturday session (8:30 AM - 4:30 PM)
  • Online option: Two evening sessions over consecutive days:
  • Session 1 (Tuesday): 6:30 PM - 10:30 PM
  • Session 2 (Wednesday): 6:30 PM - 10:30 PM

5.2 Active Participation

Participants are required to:

  • Actively engage in class discussions and group activities
  • Complete all self-reflection exercises
  • Contribute respectfully to facilitated discussions
  • Complete the workbook and final reflection tasks

Passive attendance without engagement does not constitute satisfactory participation.

5.3 Completion of Course Materials

Participants must complete all required modules:

  • Impact of Traffic Offences/Crashes (Module 1)
  • The Role of Law Enforcement (Module 2)
  • The Impact of Alcohol and Drugs on Driving (Modules 3&4)
  • Behavioural Change and Risk Reduction - Fatigue & Distractions (Modules 5&6)
  • Personal Responsibility and Road Safety (Module 7)
  • Vehicle Safety, Vehicle Maintenance & Provisional Licence Holders (Module 8)

All workbook questions and the final reflection must be completed to a satisfactory standard.

5.4 Online Session Behaviour Requirements

For participants attending via Zoom:

  • Camera must remain on at all times during sessions
  • Participants must notify the facilitator via chat if they need to leave their screen (e.g., bathroom break)
  • Participants must be in a quiet, private environment free from distractions
  • Recording of sessions is strictly prohibited
  • Use of mobile phones or other devices during sessions is not permitted
  • Appropriate attire and conduct is required at all times

5.5 Face-to-Face Session Requirements

For participants attending in-person sessions:

  • Sessions are held at Unit 6/20-21 Lambridge Place, Penrith
  • Arrive at least 10 minutes before the scheduled start time (8:30 AM)
  • Bring note-taking materials and a willingness to participate
  • Mobile phones must be switched off or on silent mode during sessions
  • Lunch break is provided from 1:00 PM - 1:45 PM
  • Participants are responsible for their own lunch arrangements

5.6 Respect and Appropriate Conduct

All participants must:

  • Treat facilitators, presenters, and fellow participants with respect
  • Refrain from disruptive, aggressive, or offensive behaviour
  • Maintain confidentiality regarding personal information shared by other participants
  • Avoid language or conduct that is discriminatory, harassing, or inappropriate
  • Follow all reasonable directions given by facilitators

5.7 Privacy and Confidentiality During Sessions

Participants must respect the privacy of others by:

  • Not recording, photographing, or capturing images/audio of sessions
  • Not sharing personal information disclosed by other participants outside the programme
  • Maintaining confidentiality of case studies and personal stories shared during sessions

5.8 Substance-Free Participation

Participants must not attend sessions while under the influence of alcohol or drugs. Any participant suspected of being impaired will be asked to leave and will not receive credit for that session.

5.9 Consequences of Non-Compliance

Failure to comply with these programme rules may result in:

  • Removal from the session without refund
  • Non-completion of the programme
  • No certificate issued
  • No court report provided
  • Requirement to re-enrol and pay full fees again

Link Foundation AOD reserves the right to remove any participant whose behaviour is disruptive, dangerous, or contrary to programme objectives.

6. Payment and Rescheduling Policy

6.1 Standard Fees

  • Face-to-face course: $180 (standard rate)
  • Online course: $180 (standard rate)
  • Concession rate: $144 (20% discount with valid concession card)

6.2 Non-Refundable Payment

All programme fees are non-refundable once payment has been made.

If a participant pays for the programme and does not attend on the scheduled date, the payment will not be refunded. In place of a refund, participants will be offered up to two opportunities to re-book and complete the programme at a later date, subject to availability.

These re-bookings must be used within the specified timeframe advised by the provider.

This policy ensures programme continuity and fairness, as places are limited and resources are allocated upon booking.

6.3 Rescheduling by Participant

Participants who cannot attend their scheduled session may re-book at no additional cost:

  • First re-booking: No additional fee
  • Second re-booking: No additional fee
  • Re-bookings are subject to availability in alternative sessions
  • Re-bookings must be requested prior to the scheduled course date
  • Re-bookings must be made within 30 days of the original scheduled date. If more than 30 days have passed, participants cannot reschedule
  • Re-bookings must be used within the timeframe advised by Link Foundation AOD
  • No refunds will be provided for unused re-bookings

To request a re-booking, contact us as soon as possible:

6.4 Cancellation or Rescheduling by Link Foundation AOD

If Link Foundation AOD must cancel or reschedule a course due to unforeseen circumstances, participants will be offered:

  • Transfer to another available date at no additional cost, OR
  • Full refund of course fees (this is the only circumstance where refunds are provided)

6.5 Non-Completion Due to Participant Non-Compliance

No refund or re-booking opportunities will be provided if a participant:

  • Fails to attend all required sessions without prior notice
  • Is removed from the programme for breach of conduct rules
  • Does not complete required coursework or assessments
  • Does not meet programme requirements for any reason
  • Exhausts their two re-booking opportunities

In such cases, participants must re-enrol and pay full fees again to complete the programme.

6.6 Payment Processing

All payments are processed securely through our payment provider (Stripe).

Once payment is confirmed, your place in the programme is reserved and the non-refundable payment policy applies.

Link Foundation AOD:

8. Changes to Terms

Link Foundation AOD reserves the right to modify these Terms and Conditions at any time. Changes will be effective immediately upon posting to this website.

Continued use of the website or participation in programmes after changes are posted constitutes acceptance of the modified terms.

For participants already enrolled at the time of changes, the terms in effect at the time of enrolment will apply to that specific course enrolment.

We recommend reviewing these Terms and Conditions periodically for any updates.
